What did Duologi do wrong?
The type of agreement you signed there should last no more than 12 months from the time you sign the agreement to the final payment (normally 11 months and 25 days). We pay the supplier once they notify us that you have received the goods and we activate the loan at the same time. If the supplier takes more than 6 days to deliver the goods to you (which is the case in this instance) the agreement will last at least 12 months + 1 day from the date you sign the agreement. This therefore needs to be transacted on an agreement regulated by the Consumer Credit Act.
What difference does a regulated agreement make?
There are additional protections and rights under this type of agreement and in particular rights under Section 75 of the Consumer Credit Act.
What rights does Section 75 give to me?
For this type of agreement if the supplier of the goods or services financed by the agreement does not supply these goods or services of satisfactory quality, they are not as described, or do not perform the function you were led to believe, then ordinarily you would go back to the supplier to rectify this.
If the supplier refuses or is no longer trading then you have the right to demand that we do this instead of the supplier.
What should I do if the goods or services provided are not satisfactory?
In the first instance you should contact the supplier to remedy any defects. You should contact us if the supplier is either not willing or able to do this or no longer exists.
What if I complained to the supplier but they didn’t resolve it?
Please contact us, including any response or information you received from the supplier. We will conduct an independent review, but cannot guarantee your complaint will be upheld.
What difference does this make to me if the goods or services are satisfactory?
None – this only applies where you have a complaint about the goods or services.
Do I still need to make repayments?
Yes. Although we did not set out all of the rights you have under this agreement, it does not remove your obligation to repay the credit you borrowed and any interest due to us.
Will this affect my credit history?
No. Providing you continue to make payments there is no effect on your credit rating from this.
